1. Acceptance of Terms
By accessing or using Zainify AI Photography ("the Service") at photography-ai.thezainify.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms apply to all users, including visitors, registered users, and subscribers. We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
2. Description of Service
Zainify AI Photography provides an AI-powered image generation platform that enables users to:
- Upload product or clothing images for AI-assisted professional photography generation
- Generate high-quality product photographs using Industry-leading AI technologies
- Access specialized engines for women's fashion, men's fashion, footwear, and general product photography
- Store and manage a library of generated images
- Purchase subscription plans with generation credits
The Service is intended primarily for e-commerce sellers, fashion brands, and creative professionals in Pakistan and internationally.
3. User Accounts
- You must be at least 18 years old to create an account.
- You are responsible for maintaining the confidentiality of your account credentials.
- You must provide accurate and complete registration information.
- You may not share your account with others or operate multiple accounts to circumvent restrictions.
- You are responsible for all activities that occur under your account.
- We reserve the right to suspend or terminate accounts that violate these Terms.
4. Credits & Subscriptions
Our Service operates on a credit-based system. Credits are consumed when generating images:
- Standard Resolution: 1 credit per generated image
- 2K Resolution: 2 credits per generated image
Subscription Plans

- Credits expire at the end of the subscription period and are not carried over.
- Credits are non-transferable between accounts.
- Subscriptions do not auto-renew; they must be manually renewed.
- Credits deducted for failed generations are automatically refunded to your account.
5. Acceptable Use Policy
You agree NOT to use the Service to generate, upload, or distribute:
- Sexually explicit, obscene, or pornographic content
- Images of real people without their consent
- Content that promotes violence, hatred, or discrimination
- Content that infringes on copyrights, trademarks, or intellectual property rights of others
- Deepfakes or deceptive content intended to mislead
- Any content that violates applicable Pakistani or international law
- Spam, malware, or any malicious content
â ī¸ Violation of this policy may result in immediate account termination without refund and reporting to relevant authorities where required by law.
6. Content Ownership & License
Your Content
You retain full ownership of images you upload to the Service. By uploading, you grant us a limited, temporary license to process your images solely for the purpose of generating AI output.
Generated Output
Generated images are provided to you for your personal and commercial use. You may use generated images for e-commerce listings, social media, and marketing materials. You may not:
- Claim AI-generated images as hand-crafted original photography when legally required to disclose
- Resell or redistribute the Zainify AI platform itself
- Use generated images for illegal purposes
Our Platform
All platform code, design, branding, and proprietary prompt engineering systems are owned by Zainify AI and protected by applicable intellectual property laws.
7. AI Generation Disclaimer
Our Service uses Third-party AI models. As such:
- AI-generated results may vary and are not guaranteed to exactly match your expectations.
- We cannot guarantee 100% accuracy in replicating colors, patterns, or design details.
- AI models may occasionally produce unexpected results due to the nature of generative AI.
- Certain image types or prompts may be blocked by AI safety filters beyond our control.
- Credits are refunded automatically when generation fails due to system or API errors.
We continuously improve our prompt engineering to maximize fidelity, but AI generation inherently involves variability.
8. Payment & Billing
- All payments are processed in Pakistani Rupees (PKR) via PayFast.
- Prices are subject to change with prior notice.
- We do not store your payment card information on our servers.
- A valid transaction ID is issued for every successful payment.
- If a payment is processed but credits are not added, contact support within 7 days with your transaction ID.
9. Refund Policy
Due to the nature of digital AI services, we maintain the following refund policy:
- Automatic Credit Refund: Credits are automatically refunded when image generation fails due to a system error on our side.
- No Refund on Used Credits: Credits that have been successfully used for image generation are non-refundable.
- Payment Disputes: If you were charged but received no credits, contact us within 7 days with proof of payment at support@thezainify.com.
- Exceptional Cases: Refund requests due to service unavailability lasting more than 48 hours will be reviewed case-by-case.
Subscription fees are non-refundable once the plan is activated and credits have been issued to your account.
10. Account Termination
We reserve the right to suspend or terminate your account, with or without notice, if:
- You violate these Terms of Service
- We detect fraudulent, abusive, or harmful activity
- We are required to do so by law
You may also request deletion of your account at any time by contacting support@thezainify.com. Upon deletion, all your data, images, and remaining credits will be permanently removed.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Zainify AI Photography shall not be liable for:
- Indirect, incidental, or consequential damages arising from use of the Service
- Loss of business, revenue, or profits due to service interruption
- Any damages resulting from AI-generated content used in your business
- Third-party service failures (Google AI APIs, PayFast, Hostinger)
Our total liability to you for any claim shall not exceed the amount you paid for the subscription in the 30 days preceding the claim.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Pakistan.
